TERMS AND CONDITIONS OF SALE

PAYMENT

Payment shall be made as established in the invoice issued for the order. Costs and interest shall be applied in the case of late payment, without prejudice to any claims for damages TAXES: VAT at the current rate

PLACE OF PERFORMANCE

Both parties shall submit any disputes to the jurisdiction of the competent Courts and Tribunals of Durango, and expressly waive any other jurisdiction to which they may be entitled even in the case of direct debit payments in another town or city coming under enforceable proceedings. They hereby acknowledge that any cost arising from the claims (costs, charges or fees...) shall be for their sole account, even in those proceedings where Autodistribution Carpriss, S.L.U., representing itself, avails of solicitor and barrister.

LIABILITY

We shall not be liable for any damage that may result from the use of the goods.

QUANTITY DETERMINATION

The quantity shall be solely deemed to be that recorded at the time of the goods leaving our warehouses, which is when the goods are considered to be placed at the disposal of the purchaser.

CARRIAGE

In Spanish territory, except for the Canary Islands, orders for under €400 (net) shall be sent carriage paid and included in the invoice, except when the customer asks that the shipment be sent using its transport agency. AUTODISTRIBUTION CARPRISS S.L.U. shall pay the carriage for overs over €400 (net). The goods shall be transported at the risk of the purchaser, even when sent carriage paid. When the goods are transported by a transport agency at the request of the customer, the shipment shall always be freight collect.

If the means of transport has not been expressly agreed, it shall be chosen by AUTODISTRIBUTION CARPRISS S.L.U. A claim must be made within 24 hours if the material received is defective. That claim shall be made directly to the carrier. The fact of signing as received in good order puts an end to any possibility of a claim for damage in the carriage. It is therefore recommended to indicate the "pending review" clause on the consignment note, as there are cases that the product is damaged due to the nature of the material even though the packaging is not affected.

URGENT SHIPMENTS

Urgent orders shall be at the disposal of the carrier on the very day they are ordered, provided that:

The customer so indicates when placing the order
The order is for less than six items and is placed with us before 4.30 p.m. from Monday to Thursday and before 2.00 p.m. on Fridays.

RETURN PROCEDURE

Any product with a manufacturing defect shall be replaced by another with the same or similar characteristics within three months. The company reserves the right to carry out any checks that it deems appropriate.

The return of any material in good condition or serviceable shall not be accepted, as purchases are binding and must be regarded as such. In the case of a non-conformity or claim by the customer, the procedure is as follows:

Notify the AUTODISTRIBUTION CARPRISS S.L.U. central offices by email.
Indicate the delivery note number, the code of the product to be returned, the quantity and the reason for returning the item.

Goods may not be returned after 15 days. Should they be accepted when required by the customer, the price shall be depreciated by at least 20% as handling costs.

The material shall be returned using the means of transport indicated by our customer service department.

OBSOLETE ITEMS

Any item not included in this catalogue shall be deemed to be "DISCONTINUED" and can therefore not be included in future orders or returns.

ACCEPTANCE OF THESE GENERAL TERMS & CONDITIONS

Regular customera are presumed to know and accept with these general terms and conditions. Their full acceptance by the customer is likewise presumed unless the customer has not expressly demonstrated its non-compliance by return post on confirmation of the order. In any event, acceptance of the goods implies full acceptance by the purchaser of these general terms and conditions of sale and the special ones for each transaction.
